MINUTES OF THE REGULAR MEETING

WEBSTER PARISH POLICE JURY

January 7, 2014

 

MEMBERS:  Jim Bonsall, President; Vera Davison, Vice President; Charles Walker; Steve Ramsey; Bruce Blanton; Perry Kirkland; Steve Lemmons; Jerri Lee; Daniel Thomas; Randy Thomas; Allen Gilbert; and Charles Odom

 

PUBLIC HEARING:     To hear comments concerning the adoption of a resolution ordering and calling a special election to be held in the Parish of Webster to authorize the renewal of a special tax therein; and to make application to the State Bond Commission in connection therewith; and providing for other matters in connection therewith.  There were no comments concerning this matter.

 

PUBLIC HEARING:     To hear comments concerning the amendment and reduction of the boundaries of Fire Protection District # 2 (Sibley) of the Parish of Webster, State of Louisiana as proposed in resolution of intention adopted on December 3, 2013.  There were no comments concerning this matter.

 

Ret. Judge Graydon Kitchens opened the meeting with prayer and COL John Hennigan, Jr. then led in the Pledge of Allegiance. 

 

The first order of business is the election of Officers for the year 2014:

 

Mr. Charles Walker nominated Mr. Jim Bonsall for President.  There being no further nominations brought to the Jury, Mr. Bonsall is elected by acclimation.

 

Mr. Charles Walker nominated Ms. Vera Davison for Vice President.  There being no further nominations brought to the Jury, Ms. Davison is elected by acclimation.

 

Mr. Bonsall and Ms. Davison expressed their appreciation and support to the Jury.

 

Mr. Bonsall then asked for a motion to approve the appointment of Ronda Carnahan, Secretary-Treasurer for a two year term, and Lisa Balkom, Asst. Secretary-Treasurer for a two year term.  Mrs. Jerri Lee moved to approve the appointments, seconded by Mr. Charles Odom.  Motion carried unanimously.

 

Mr. Daniel Thomas moved, seconded by Mr. Perry Kirkland to set the day and time for the Regular Police Jury Monthly Meetings to be the 1st Tuesday of the month at 10:30 A.M. in the 2nd Floor Meeting Room of the Webster Parish Courthouse.  Motion carried unanimously.

 

Ms. Vera Davison moved, seconded by Mr. Randy Thomas to approve a signature resolution giving the President, Secretary-Treasurer and the Asst. Secretary-Treasurer authority to sign documents and financials for the Webster Parish Police Jury for 2014.  Motion carried unanimously.

 

The next item on the agenda is additions to the agenda.

Mr. Allen Gilbert moved, seconded by Mr. Bruce Blanton to add to the agenda 18-B Cullen Fire District Board Appointments.  Motion carried unanimously.

 

Mr. Charles Odom moved, seconded by Mr. Charles Walker to add to the agenda #19A- Discretionary Funding for District 8.  Motion carried unanimously.

 

Mr. Randy Thomas moved, seconded by Mrs. Jerri Lee to add to the agenda # 19B – Discretionary funding for District #4.  Motion carried unanimously.

 

Mr. Bonsall then asked for audience comments.  Mr. Javon Branch spoke to the Jury.

 

Mr. Steve Lemmons moved, seconded by Mr. Perry Kirkland to adopt the minutes of the December 3, 2013 Finance Committee and Road Committee Meetings, and to approve the December 3, 2013 Regular Meeting minutes.  Motion carried unanimously.

 

Mr. Bruce Blanton moved, seconded by Ms. Vera Davison to approve invoices pending review of the committee.  Motion carried unanimously.

 

Mr. Charles Walker moved, seconded by Mrs. Jerri Lee to adopt the 2014 Operating Budget of the Webster Parish Police Jury with actual brought forward figures.  Motion carried unanimously.

 

Mr. Charles Odom moved, seconded by Mr. Steve Ramsey to approve the audit engagement of Allen Green and Williamson for the 2013 Audit of Financials and to engage Jamison Wise and Martin, CPA for the preparation of Trial Balance and other CPA duties for 2014.  Motion carried unanimously.

Regular Meeting – January 7, 2014- Continued

 

The next item on the agenda is action to be taken for the Webster Parish Office of Community Services.  Mrs. Jerri Lee moved, seconded by Ms. Vera Davison to approve the following:  To appoint Mrs. Mary Whitaker Executive Director, Webster Parish Police Jury office of Community Services for the year 2014; to approve Signature Resolution for WPPJOCS for 2014; and to approve a Resolution for DOTD Handicap Accessibility Grant Application, “New Freedom” grant.  Motion carried -11 yeas, Odom abstain.

 

Public Works items were presented for approval.  Mr. Daniel Thomas moved, seconded by Mr. Bruce Blanton to approve the following Public Works items:

*To approve 2014 Road Materials Bid pending review of the Public Works Director pending legal review.

* To approve a Resolution from the Town of Sibley for repairs to SE 5th Avenue.

* To approve a Resolution from the Town of Sarepta for installation of culverts on as needed basis.

* To approve a Resolution from the Town of Sarepta for repairs with hot mix at intersection of S. Main and Palmer.

* To approve a request from the North Webster Parish Industrial District to change signage for newly named Rex Bryan Drive, NWPID will incur all cost.

Motion carried unanimously.

Mr. Steve Ramsey moved, seconded by Mr. Allen Gilbert to approve Webster Parish Ordinance # 1010 to reduce the boundaries of FPD#2 (Sibley) of the Parish of Webster, State of Louisiana, confirming the corporate powers of said District and providing for other matters.  Motion carried unanimously.

 

Mrs. Jerri Lee moved, seconded by Mr. Charles Walker to approve Webster Parish Resolution #003-2014 calling a special election to be held in the Parish of Webster, State of Louisiana, to authorize the renewal of a special tax therein, making application to the State Bond Commission in connection therewith; and providing for other matters.  Motion carried unanimously.

 

Mr. Perry Kirkland moved, seconded by Mr. Bruce Blanton to ratify disbursement of Parish Recreational funding for 2013 in District # 5:  $293.68 to Cotton Valley PD for doors on the station, and $650.00 for WPFD#7 Fire Department repairs.  Motion carried unanimously.

 

Mr. Daniel Thomas moved, seconded by Mrs. Jerri Lee to approve the following reappointments to the Webster Parish Convention and Visitor’s Bureau:

To reappoint Kristi McClain to a 3 year term and to reappoint Lamar Smith to a 3 year term. 

Motion carried unanimously.

 

The next item is discussion of the Cullen Fire Department Board appointments.  The Webster Parish Police Jury received a request from Asst. Fire Chief Thomas Arnold to reappoint Mr. Barry Smith to a 3 year term.  Mr. John Stanley, WP OEP/HS Director spoke to the Jury concerning the board appointments.  Mr. Stanley stated that after consulting with legal counsel, and due to the fact that there is not a board in place to conduct business, Mr. Stanley recommended that the Jury make the following appointments:

There are two Webster Parish Police Jury board appointments open.  Mr. Kenneth Garrett had stepped down as Chairman last year in order for Mr. Stephens to be appointed Chairman.  Mr. Stephens has since resigned.  To re-instate Mr. Kenneth Garrett as Chairman of the Board for a one (1) year term of office; To appoint Mr. Ted Owens as a board member for a one (1) year term, Webster Parish Appointment, To appoint Mr. Michael Lawler as a board member for a one (1) year term, Webster Parish Police Jury Appointment, and to reject the request from Asst. Chef Thomas Arnold to reinstate Mr. Barry Smith as a board member.

Mr. Allen Gilbert moved, seconded by Mr. Daniel Thomas to approve the recommendation for board appointments as presented.  Motion carried unanimously.

COMMITTEE REPORTS:

 

No Committee meetings for approval

Mr. Perry Kirkland extended his best wishes to the Jury and all in attendance.  Looking forward to a good 2014.

 

Mr. Charles Odom extended his appreciation to Mrs. Beverly Hammett, Webster Parish Library for her assistance in all community endeavors.  Mr. Odom then spoke to Mrs. Joan Almond concerning the recycling trailer located at the Extension office.  He is working to have the trailer moved due to the problem with garbage being dumped at this site. 

Mr. Odom then informed everyone that he and several other community leaders had worked together to provide a parish parade float “Mardi Gras”,  to be used at any and all events.

 

Ms. Vera Davison thanked Mr. Charles Walker for his nomination for Vice President and thanked the Jurors for their support.  Ms. Davison then stated that she would work in her community to get the word out about the Library Tax “renewal” at the same rate to continue to operate and maintain the Parish Libraries. 

 

Mr. Charles Walker extended his congratulations to Mr. Jeff Sibley on his appointment as the new LA WF Biologist Manager.  Mr. Walker also told the Jury that Mr. Bonsall is a Leader and he is glad that he was able to nominate him as the Police Jury President for 2014 and Ms. Davison for Vice President.

 

Mr. Bonsall then gave his closing remarks including his appreciation for the support of the Jury in 2013 and looks forward to 2014.  He expressed his appreciation to the support staff as well.

                        The President of the Police Jury then announced that it was ten-thirty o’clock (10:30) a.m., and time to hear any and all objections to the amendment and reduction of the boundaries of Fire Protection District No. 2 (Sibley) of the Parish of Webster, State of Louisiana, as proposed in resolution of intention adopted by the Police Jury on December 3, 2013.

                        The President then stated that the Notice of Intention which the Police Jury had issued on December 3, 2013, giving notice of intention of said Police Jury to amend and reduce the boundaries of said District had been published in the "Springhill Press-News Journal", Springhill, Louisiana, on December 12 and December 19, 2013.

                        The President then called for objections to the proposed amendment and reduction of the boundaries of said District from the Police Jurors, citizens, property owners and other interested parties present at the meeting.

                        No one present at the meeting offered any objections, and the Secretary-Treasurer stated that no objections had been filed with her.  The President then announced that there were no objections to the amendment and reduction of the boundaries of Fire Protection District No. 2 (Sibley) as proposed in the aforesaid resolution of December 3, 2013.

WEBSTER PARISH ORDINANCE # 1010

 

An ordinance amending and reducing the boundaries of Fire Protection District No. 2 (Sibley) of the Parish of Webster, State of Louisiana, confirming the corporate powers of said District, and providing for other matters.

 

                        WHEREAS, in strict compliance with the provisions of Part I, Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto, the Webster Parish Police Jury, State of Louisiana (the "Police Jury") adopted a resolution on December 3, 2013, giving notice of its intention to amend and reduce the boundaries of Fire Protection District No. 2 (Sibley) of the Parish of Webster, State of Louisiana (the “District”), ordering and directing the President of the Police Jury to give due notice of the proposed amendment and reduction of the boundaries of said District and providing for the hearing of any and all objections thereto; and

 

                        WHEREAS, notice of intention to amend and reduce the boundaries of  the District and of the public hearing to be held in connection therewith were duly published as required by law and as directed by said resolution of December 3, 2013; and

 

                        WHEREAS, the Police Jury did at the hour and place and on the date designated in said resolution of December 3, 2013, meet in open and public session for the purpose of hearing any and all objections relative to the proposed amendment and reduction of the boundaries of the District; and

 

                        WHEREAS, no objections were filed or presented to this Police Jury in writing and no other objections were expressed, and the Police Jury is of the opinion that the proposed amendment and reduction of the said boundaries is to the best interest of the District and its inhabitants; and

 

                        WHEREAS, the District has not entered into any contracts which will be impaired by amending or reducing the boundaries of the District;

 

                        NOW, THEREFORE, BE IT ORDAINED by the Police Jury of the Parish of Webster, State of Louisiana, acting as the governing authority of the Parish of Webster, State of Louisiana, that:

 

                        SECTION 1.  In compliance with the provisions of Part I, Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority, the boundaries of Fire Protection District No. 2 (Sibley) of the Parish of Webster, State of Louisiana (the “District”), are hereby amended and reduced such that the area encompassed by the present boundaries of the Town of Sibley, State of Louisiana, is excluded from the boundaries of the District.

 

                        SECTION 2.    The District shall continue to be known as "Fire Protection District No. 2 (Sibley) of the Parish of Webster, State of Louisiana", and shall continue to constitute a

Public corporation and political subdivision of the State of Louisiana, and as such, shall have all the powers incidental thereto as granted by the Constitution and Statutes of the State of Louisiana, including the authority to incur debt, to issue bonds and to levy taxes and parcel fees.

                        SECTION 3.  Due notice of the amendment and reduction of the boundaries of the District shall be published in the official journal of the Police Jury in accordance with law, and the President of this Police Jury is hereby ordered, directed and instructed to issue the required notice and to cause the same to be published in the manner provided by law, a copy of which is attached as "Exhibit A".

 

                        SECTION 4.  This ordinance shall not be interpreted or construed as having any effect on the District or its governing authority other than effecting a change in the boundaries and territorial limits of the District, as hereinabove set forth.

 

                        SECTION 5.  This ordinance shall be published in full in one (i) issue of the official journal of the Police Jury as soon as possible and shall be in full force.

                        Pursuant to the provisions of an ordinance adopted by the Police Jury of the Parish of Webster, State of Louisiana, on January 7, 2014, NOTICE IS HEREBY GIVEN, in accordance with the provisions of Part I, Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto, notice is hereby given that the boundaries of Fire Protection District No. 2 (Sibley) of the Parish of Webster, State of Louisiana have been amended and reduced to remove the area encompassed by the present boundaries of the Town of Sibley, State of Louisiana.

RESOLUTION

 

A resolution ordering and calling a special election to be held in the Parish of Webster, State of Louisiana, to authorize the renewal of a special tax therein; making application to the State Bond Commission in connection therewith; and provid­ing for other matters in connection there­with.

 

                  BE IT RESOLVED by the Police Jury of the Parish of Webster, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Parish of Webster, State of Louisiana (the "Parish"), that:

 

                  SECTION 1.    Election Call.  Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Section 26 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, MAY 3, 2014, between the hours of seven o'clock (7:00) a.m. and eight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

Shall the Parish of Webster, State of Louisiana (the “Parish”), continue to levy and collect a special tax of twelve (12) mills on all the property subject to taxation within the Parish (an estimated $2,944,100 expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2015 and ending with the year 2024, for the purpose of acquiring, constructing, improving, furnishing, equipping, operating and/or maintaining public libraries in Webster Parish?

 

                  SECTION 2.    Publication of Notice of Election.  A Notice of Special Election shall be published in the Springhill Press & News Journal, a newspaper of general circulation within the Parish, published in Springhill, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as "Exhibit A" and incorporated herein by reference the same as if it were set forth herein in full.

 

                  SECTION 3.    Canvass.  This Governing Authority shall meet at its regular meeting place, the Police Jury Meeting Room, 2nd Floor, Webster Parish Courthouse, 410 Main Street, Minden, Louisiana, on TUESDAY, JUNE 3, 2014, at TEN-THIRTY O'CLOCK (10:30) A.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

 

                  SECTION 4.    Polling Places.  The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

 

                  SECTION 5.    Election Commissioners; Voting Machines.  The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Tuesday, June 3, 2014, as

provided in Section 3 hereof.  All registered voters in the Parish will be entitled to vote at the special election, and voting machines shall be used.

 

                  SECTION 6.    Authorization of Officers.  The Secretary-Treasurer of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary-Treasurer of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election.

 

                  SECTION 7.    Furnishing Election Call to Election Officials.  Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Webster Parish and the Registrar of Voters of Webster Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

 

                  SECTION 8.    Application to State Bond Commission.  Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to continue to levy and collect the special tax provided for therein.  A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

 

                  SECTION 11.  Additional Notice Requirement.  This Governing Authority made the announcement with respect to this resolution required by La. R.S. 42:19.1, at its public meeting on Tuesday, December 3, 2013 and published said announcement in the Official Journal on Thursday, December 5, 2013.

 

This  resolution having been submitted to a vote, the vote thereon was as follows:

                  The polling places set forth above are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, shall be those persons designated according to law.

 

                  Notice is further given that a portion of the monies collected from the tax described in the Proposition shall be remitted to certain state and statewide retirement systems in the manner required by law.

 

                  The said special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to said Governing Authority, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet at its regular meeting place, the Police Jury Meeting Room, 2nd Floor, Webster Parish Courthouse, 410 Main Street, Minden, Louisiana, on TUESDAY, JUNE 3, 2014, at TEN-THIRTY O'CLOCK (10:30) A.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.  All registered voters of the Parish are entitled to vote at said special election and voting machines will be used.
